Philadelphia Ordinance Banning Questions About Salary History Has Been Stayed

As you may recall, on January 23, 2017, Philadelphia became the first city in the country to pass an ordinance prohibiting employers from inquiring about a prospective employee’s salary history.    Enforcement of the Philadelphia Ordinance banning employers from asking job candidates about their salary history has been voluntarily delayed by the City while the federal court considers its constitutionality. The Court granted an initial stay after the Chamber of Commerce and other similar organizations challenged the City Ordinance on a number of grounds. The voluntary stay is indefinite while the parties file briefs on the issues and the Court enters a ruling.

The law was to become effective May 23, 2017.
